Terms of Service & User Agreement

1. Acceptance of Terms
By accessing or using the Install Portal web application ("Portal") and/or the Install Portal mobile application ("App"), collectively referred to as the "Platform," you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.
2. Description of Service
Install Portal is a field operations management platform designed for appliance installation companies. The Platform enables project management, job scheduling, field crew tracking, purchase order management, photo documentation, change order workflows, and automated reporting.
3. User Accounts & Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials (PIN, password, or login token).
- You must not share your account with others or allow unauthorized access.
- You agree to provide accurate information when creating or updating your profile.
- You must immediately notify your administrator of any unauthorized use of your account.
- Lead installers are responsible for the actions of helpers added to their crew.
4. Acceptable Use
You agree NOT to:
- Use the Platform for any unlawful purpose.
- Upload false, misleading, or fraudulent information (including photos, serial numbers, or completion records).
- Attempt to access data belonging to other organizations or users without authorization.
- Tamper with GPS location data, clock events, or job status records.
- Reverse engineer, decompile, or disassemble any part of the Platform.
- Use automated scripts or bots to interact with the Platform without prior authorization.
5. Data & Privacy
- Location Data: The App collects GPS location data during active work sessions for job tracking and verification. Location tracking stops when you clock out.
- Photos: Photos taken through the App are uploaded to secure cloud storage and associated with specific jobs and purchase orders.
- Personal Information: We collect name, email, phone number, and employment details necessary for Platform operation.
- Data Retention: Job records, photos, and completion data are retained for the duration of your organization's subscription plus any required legal retention period.
- Third-Party Services: The Platform may integrate with third-party services (e.g., LimeTAC, email providers). Your data shared with these services is governed by their respective privacy policies.
6. Intellectual Property
All content, features, and functionality of the Platform are owned by the Platform operator and are protected by copyright, trademark, and other intellectual property laws. Job data, reports, and records created by your organization belong to your organization.
7. Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. IN NO EVENT SHALL THE PLATFORM OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. THE PLATFORM OPERATOR'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOUR ORGANIZATION IN THE 12 MONTHS PRECEDING THE CLAIM.
8. Termination
We may suspend or terminate your access at any time for violation of these Terms. Your organization's administrator may also deactivate your account. Upon termination, your right to use the Platform ceases immediately.
9. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or in-app notification.
10. Governing Law
These Terms are governed by the laws of the Province of Alberta, Canada. Any disputes shall be resolved in the courts of Alberta.
